Changing Your Service of Process Address or Agent in New York
In New York, changing your agent for service of process or the DOS forwarding address requires filing with the Department of State. Because the Secretary of State is automatically your agent (mandatory), what you are really changing is either: (1) the address where DOS forwards served documents, or (2) your optional designated registered agent. For all compliance requirements, see our post-formation guide.
Changing the DOS Forwarding Address
If you move and need to update where the Department of State mails served process:
Option 1: File Articles of Amendment (DOS-1369)
- Fee: $60
- Changes the address on your Articles of Organization
Option 2: File via Biennial Statement
- When your Biennial Statement is due ($9), you can update the address at that time
- No additional fee beyond the $9
Changing or Adding an Agent for Service of Process
If you want to designate (or change) an agent for service of process who receives process directly:
- File Articles of Amendment (DOS-1369) — $60
- Include the new agent's name and NY address
- The agent must consent before filing

FAQ
Is there a separate "change of agent" form in NY?
No dedicated form. Changes to service of process arrangements are made via Articles of Amendment (DOS-1369, $60) or noted on your Biennial Statement when due.
What happens if I do not update my address?
The DOS will mail served process to the old address. If it is returned undeliverable, service is still legally complete from the date the DOS accepted it. You may not receive notice of lawsuits, leading to default judgments.
How quickly does the change take effect?
Upon filing with the DOS. Online amendments process in 5-7 business days.
